By accessing or using the visuary.ai website (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and others who access the Site.

The Site is a marketing and informational website for Visuary AI, a decision-support platform for the ACA individual health insurance market and ICHRA employer benefits programs. The Site provides information about Visuary AI's solutions — ICHRA Model and Plan Navigator — and allows visitors to request product demonstrations.

The Site does not provide insurance, financial, legal, medical, or actuarial advice. Information presented on the Site is for general informational purposes only and should not be relied upon as professional advice.

3. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, product names, and descriptions — is the property of Visuary AI or its licensors and is protected by applicable intellectual property laws.

Visuary AI's core plan-scoring algorithm is the subject of a pending patent application. All rights in and to the algorithm, methodology, and associated technology are reserved.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written consent.

4. Permitted Use

You may access and use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Site or its related systems
• Use automated tools (scrapers, bots, crawlers) to collect information from the Site without our written permission
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of the Site
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Demo Requests and Communications

When you submit a demo request through the Site, you are requesting a product demonstration from Visuary AI. Submission of a demo request does not create a binding contract, guarantee a demonstration, or obligate either party to enter into any business relationship.

By submitting your contact information, you consent to being contacted by Visuary AI regarding your inquiry via email or phone. You may opt out of communications at any time by notifying us through the contact form.

6. Third-Party Links and Services

The Site may contain links to third-party websites or integrate third-party services (such as Calendly for scheduling). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of any third-party site or service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VISUARY AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Visuary AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.
